During the 2017 Legislative Session, two bills were introduced in the Texas Legislature regarding Legal Fantasy Sport. House Bill 1457, introduced by Representative Richard Raymond, would have provided clarified that paid daily fantasy sports are not gambling under Texas law and declared that it is the policy of this state that paid daily fantasy sports contests are a game of skill. The bill received a public hearing in the House Committee on Licensing & Administrative Procedures but was left pending in committee at the end of the session.

Senate Bill 744, introduced by Senator Charles Schwertner, would have also provided that paid daily fantasy sports are not gambling under Texas law. In addition, the bill would have created criminal and civil penalties for internet service providers and payment processors who knowingly facilitate illegal online gambling transactions. The bill received a public hearing in the Senate Committee on State Affairs but was left pending in committee at the end of session.

The National Fantasy Football Championship (NFFC) and the National Fantasy Baseball Championship (NFBC) are the two largest companies that host Legal Fantasy Sport contests in the United States. These companies are currently in support of legislation that would make playing Legal Fantasy Sport in Texas legal.

The NFFC and NFBC have been working with legislators in Texas to create a bill that would explicitly exempt Fantasy Sport from gambling laws. This bill has not yet been introduced in the legislature, but if it passes, it would make playing Legal Fantasy Sport in Texas legal.
